he Court of Appeal yesterday dismissed without costs the application filed by petitioner General (Rtd) Sarath Fonseka challenging the Second Court Martial appointed to try him for offenses committed while holding office of the Army Commander. The Court noted that the petitioner failed to agitate the grievance if any at the earliest opportunity and is guilty of lapses as far as the application is concerned. "Having considered the merits of this application, I see no basis to issue notice."
